Terms of Service

• You must provide accurate information when creating an account and keep your credentials secure.
• You are responsible for all activity under your account.
• You must be at least 16 years old to use the Service.

• Paid plans are billed in advance on a recurring basis until cancelled.
• You may cancel at any time from your account; cancellation takes effect at the end of the current billing period.
• Except where required by law, fees are non-refundable.
• We may change pricing with reasonable prior notice.
• Fair use: paid plans are marketed as "unlimited" generations subject to a fair use allowance of 500 AI generations per billing month per account.
• This allowance is intended to cover normal individual and small-team use.
• If you exceed the allowance, we may contact you, throttle generation speed, or ask you to move to a higher tier for sustained heavier usage.
• We will not silently cut off access without notice for good-faith use within reason of this limit.

• You retain ownership of designs, artwork, product mockups, and other content you upload or generate ("Your Content").
• You grant us a worldwide, non-exclusive licence to host, process, and display Your Content solely to operate and improve the Service for you.
• You are responsible for ensuring you have the rights to upload Your Content and that it does not infringe third-party rights, including trademarks, copyrights, and rights of publicity.

You agree not to use the Service to:

• Upload unlawful, infringing, hateful, or sexually exploitative content.
• Impersonate others or misrepresent affiliation.
• Attempt to break, probe, or overload the Service.
• Scrape or resell the Service without written permission.

• The Service uses AI models to generate mockups and assist with product creation.
• AI output may be inaccurate or unsuitable for production.
• You are responsible for reviewing and approving any output before commercial use.

• The Service, including its software, branding, and design, is owned by Merch Studio and protected by intellectual property laws.
• We grant you a limited, revocable licence to use the Service in accordance with these Terms.

• We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users, or third parties.
• You may stop using the Service at any time.

• The Service is provided "as is" without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

• To the maximum extent permitted by law, Merch Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data.
• Our aggregate liability for any claim related to the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

• We may update these Terms from time to time.
• Material changes will be communicated by email or in-app notice.
• Continued use after the effective date constitutes acceptance.
